Terms and Conditions

  1. The Tenant Referral Programme (“Programme”) runs from 1 January 2024 to 31 December 2024, both dates inclusive (“Promotion Period”).
  2. To be a qualified referrer (“Referrer”), a person must be an existing tenant under a tenancy agreement in relation to a residential unit of The Repulse Bay 109 (TRB), Repulse Bay Apartments 101 & De Ricou (Unfurnished or Serviced Apartment) (“Residential Properties”). Further, each Referrer and Referee (as defined below) shall only be entitled to Referral Rewards (as defined below) so long as the requirements of these terms and conditions are met.
  3. The Referrer must directly introduce a new tenant (“Referee”) to the leasing staff of The Repulse Bay Company, Limited (“TRB”, “we”, “our” or “us”) via verbal communication or in writing (“Introduction”).
  4. The Referrer shall not include any staff of The Hongkong and Shanghai Hotels, Limited or any of its affiliates (“HSH Group”).
  5. The Referee shall not include an existing tenant or occupant of any Residential Properties or any staff of HSH Group.
  6. The Programme is not applicable to leasing transactions referred by property agents. Any participant of the Programme should not carry out any estate agency work without the requisite licence(s) as otherwise, the participant may violate Estate Agents Ordinance (Cap. 511). HSH Group accepts no responsibility for the Referrer’s and/or Referee’s breach of any applicable law, rule or regulation, whether or not arising from matters relating to the Programme.
  7. The Referrer’s Introduction must precede any viewings of available units by the Referee and negotiation of any tenancy documents, and such Introduction shall be valid for six (6) months counting from the date of the Introduction. For the avoidance of doubt, if no tenancy agreement is achieved within the above said six (6) month’ period, no Referral Rewards shall be granted to the Referrer and the Referee.
  8. The Programme is not applicable to renewal of any tenancy agreement or arrangement, including internal transfers of apartments between existing tenants, and terminated lease.
  9. The Referrer and Referee shall fulfil the following pre-conditions:
    • Execution of: (i) a tenancy agreement in respect of a non-serviced apartment of the Residential Properties with a term of at least 24-months with TRB or RBA within 6 months of an Introduction; or (ii) where a Referee, within 6 months of an Introduction, enters into tenancy agreement in respect of a serviced apartment of the Residential Properties (“Serviced Apartment Licence Agreement”), then a Unfurnished Apartment Tenancy Agreement (as defined below) in accordance with Clause 10);
    •  Handover of the unit to the Referee; and
    • Payment of 1st month’s rental and security deposit under the Tenancy Agreement by the Referee;

    the fulfilment of which shall be referred to as a “Successful Referral”.       

  10. For the purposes of Clause 9(a)(ii), “Unfurnished Apartment Tenancy Agreement” means a tenancy agreement in respect of any unit of the Residential Properties that is not a serviced apartment, so long as: (i) such Unfurnished Apartment Tenancy Agreement is entered into within 3 months from the commencement date of the Serviced Apartment Licence Agreement; and (ii) the Unfurnished Apartment Tenancy Agreement has a term of no less than 2 years which commences immediately after the expiry date (or any agreed earlier termination date) of the Serviced Apartment Tenancy Agreement.
  11. The Referrer and Referee shall be entitled to receive designated rewards (“Referral Rewards”) as shown in the table below upon the occurrence of a Successful Referral.

  12. A redemption letter of Referral Rewards (“Redemption Letter”) will be issued to the Referrerand the Referee respectively within 15 days after return of the executed Tenancy Agreement.
  13. The cash bonus will be sent to the Referee and the Referrer in the form of a cheque, together with the coupons, by registered mail within 30 days’ of the date of the Redemption Letter.
  14. The Redemption Letter can only be redeemed for Referral Rewards once . Lost, stolen, or damaged Redemption Letters will not be reissued.
  15. The Programme will only be activated upon the completion of registration with all necessary information and forms.
  16. The coupons cannot be refunded and/or redeemed for cash.
  17. The coupons are supplied by Spices, Verandah and/or The Peninsula Hong Kong and are subject to respective terms and conditions.
  18. The Programme cannot be in conjunction with other promotional offers offered by HSH Group.
  19. TRB, RBA and HSH Group shall not be liable for any disputes arising between Referrer and Referee.
  20. TRB reserves the final right to cancel, terminate or change any of these terms and conditions at any time without prior notice to the Referrer and the Referee. The entitlement of the Referral Rewards shall be at the sole discretion of TRB and HSH Group.

  22. Each of TRB, RBA and HSH Group reserves the right of interpretation to the aforesaid terms and conditions in case of any dispute, which interpretation shall be binding and conclusive.
